CAIF Meeting with The Minister of immigration

On June 5, 2010 some executive members of CAIF had a meeting with The Minister of Immigration, the honorable Mr. Jason Kenney. The meeting was over an hour in duration.

CAIF has been working hard to arrange this meeting which has been in the works for some time. Sam Benet, President of the organization, Maggie Gutierrez, Vice President and Shah Moayedi executive member were present at this meeting.

A number of issues were discussed at the meeting. Many concerns the members of this organization have as well as all Canadians in order to step up the effort to combat Immigration Fraud.

Minister Kenney was impressed and acknowledged the work this organization has done in the past on behalf of all the victims.

Despite a past report, it seems that both the minister and CAIF are on the same page and have a common goal to combat this issue. Both parties want to hold fraudulent parties who are committing this act accountable for using the victims as a ticket and a way to unlawfully enter in the country.

In this meeting CAIF presented to the minister a number of signatures on the petition which was singed by members and supporters. The petition demands change and enforcement of the existing law, we also presented to the minister the list of the organizations membership list, which is growing day by day.

Some of the issues discussed in this meeting were the importance of enforcement of the law and urging the minister to crack down and punish the fraud con-artists who are committing this crime. It was also brought up the abuse of social service by these criminals, which not only directly affects the victim but it should be concern to all Canadians.

Minister Kenney was also presented with recommendations CAIF feels should be place and followed by his ministry. Suggestions were also made on amendments of the current law to prevent or make it harder for criminal minded persons who try or think about using marriage of convenient / marriage fraud, as way to enter in to Canada. This expense is not only being financially but emotionally and mentally of innocent victims who are to believe that they are in a genuine relationship. Victims are misleading by the true intention of these criminals in a fraudulent way.

Canadians Against Immigration Fraud acknowledged the work that Honorable Minister Kenney has done in the past in an effort to combat fraud in immigration. But little has been done to crack down on the issue of marriage fraud which is happening more and more. The cases being reported is more and more and is not only a burden to the victim but also to the government.

The minister acknowledged the fact this problem exists and needs to be dealt with. He has asked CAIF and the membership and their families to support him in combating this crime.

The meeting was satisfying in the ministers’ view and also by the executive member of CAIF. It was a very successful and productive meeting. CAIF and the Minister have acknowledged the importance of working closely together on this issue.

This organization is committed to fighting for justice of victims and all Canadians and to put a stop to the abuse and misuse of the immigration system.

The fraudulent criminal who commits this act should be brought to justice. When there is clear evidence that this shameful act was committed the law should be enforced and they should be deported.

We will continue to fight for this issue and helping to bring new amendments to the law to make immigration a fear deal. More so to fight the crimes and fraud in the system and we engorge the minister to do the same. This is the most rapid growing fraud which is occurring in Canada today.

New recommendations and suggestions as to how this ministry can speed up the process or acknowledging the victims concern and investigations of their cases will be presented to the minister as part of our commitment to our members and victims.

ISSUES DISCUSSED IN THE MEETING WITH THE MINISTER AND RECOMMENDATIONS MADE

  • ISSUE NO.1. ENFORCEMENT OF EXISTING LAW:

Until a Sponsored person has received his/her visa and arrives in Canada, We cannot find his/her intentions of Marriage of Convenience. We demand the Following changes in the enforcement policy:

  • a. DEFINITION OF MARRIAGE OF CONVENIENCE/ MISREPRESENTATION:

(i) After arriving in Canada, if any Sponsored Person leaves his/her Sponsor with in a short period ( means with in 3 years ) to be considered a marriage of convenience and is misrepresentation. It is a violation of Section 4 of IRPR and Section 40 ( 1 ) and 127 of IRPA.

(ii)The Immigration Officer must write the Report under Section 44 ( 1 ) and matter be referred to an Inadmissibility hearing.

(iii)The complaint must be investigated with in a reasonable time and the complainant must be informed about the progress in investigation of their complaint.

  • b. COMPLAINT OF ABUSE:

To our experience 90% of complaints of Abuse are false and are fabricated to misuse the system. The complaint of Abuse is a Criminal matter and is not a Immigration matter. We request:

(i)Unless it is proved and a person is convicted of abuse, no consideration shall be given to a complaint of abuse in the determination of Inadmissibility

ONCE THEY ARE ORDERED FOR INADMISSIBILITY HEARING, IT WILL SPREAD THE MESSAGE AROUND THE WORLD, THAT A FRAUDULENT SPOUSE CAN BE DEPORTED FROM CANADA.

  • ISSUE NO: 2: AMMENDMENT TO THE IRPA:

(i)No sponsored person under spousal sponsorship program shall be granted a Permanent Residence Status for 3 years from the date of his/her arrival In Canada. They have to prove that the marriage is genuine & working.

(ii)Any complaint of abuse shall be referred to a panel who will hear both The sponsor & sponsored spouse and decide whether the complaint is genuine.
